1. Use of the Platform

• You agree to use our Platform only for lawful purposes and in accordance with these Terms. This includes:
• Using the configurator to explore or reserve home designs
• Creating and managing your account information
• Engaging with support tools and AI-driven design features
• Making payments for reservations or services

 

You must not:

• Use the Platform for any fraudulent or commercial resale purposes
• Attempt to reverse-engineer or tamper with the system
• Upload or transmit any malicious code or harmful materials

 

2. User Accounts

To reserve a home or save design selections, you must create an account. You are responsible for maintaining the confidentiality of your account and any activity that occurs under your login. Notify us immediately of any unauthorized use.

You may only create one account unless otherwise approved by Everywhere.

 

3. Payments and Fees

Everywhere Homes processes payments through third-party providers (e.g., Stripe). By submitting a payment, you authorize us to charge your provided method for applicable reservation fees or custom design services.

Reservation fees are non-refundable except as outlined in our Reservation Agreement. Additional payment terms may apply and will be presented at the time of transaction.

You are responsible for ensuring that your payment method is current and valid.

 

4. Use of Proprietary Designs and Services

By using this Platform, you acknowledge that you are engaging with proprietary home designs, architectural plans, and brand-specific materials created exclusively by Everywhere Homes. These materials are made available solely for use within our ecosystem — including our design services, consultation, labor, and construction services.

Any unauthorized use, reproduction, modification, resale, or distribution of our plans, renders, documents, or designs outside of the Everywhere system is strictly prohibited and constitutes a violation of our intellectual property rights. All designs are protected under applicable copyright, trademark, and trade dress laws.

Violation of this clause may result in legal action, including claims for damages, injunctive relief, and recovery of legal fees.

 

5. Intellectual Property

All content on the Platform, including architectural designs, visualizations, logos, text, software, and materials, is the intellectual property of Everywhere Homes or its licensors. You may not copy, distribute, reverse-engineer, or create derivative works from any part of our system without explicit written permission.

 

6. AI-Generated Features

We use AI-generated characters and tools for support, design education, and customer service. These tools are provided for informational purposes only and are not a substitute for professional architectural, legal, or construction advice.

You acknowledge that your interactions with these tools may be recorded to improve service quality.

 

7. Limitation of Liability

To the maximum extent permitted by law, Everywhere Homes will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use arising from your use of our Platform or services.

In any case, our liability will be limited to the greater of: (a) the amount paid by you in connection with the disputed service, or (b) $100.

 

8. Dispute Resolution & Arbitration

If a dispute arises between you and Everywhere Homes, we encourage you to first contact us to seek resolution. If a dispute cannot be resolved informally, you agree to resolve any claim through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You waive your right to participate in any class action or representative proceeding. Arbitration shall take place in the county or state of your residence unless both parties agree otherwise.

You may opt out of this arbitration clause by sending a written notice within 30 days of accepting these Terms.

 

9. Modification of Terms

We may revise these Terms at any time by posting an updated version. By continuing to use our Platform after changes are posted, you agree to the revised Terms.
